The current business environment, including recent tariffs and threats of trade wars, is expected to significantly increase the risk of cost escalation for materials. During the COVID-19 pandemic of 2020, such shocks caused considerable market volatility, and many contractors discovered that the terms of their contracts did not adequately protect them from such risks.

Contractors should protect their business by arming themselves with knowledge of important contractual provisions such as material escalation terms. These terms are not one-size-fits-all and can vary greatly depending on the project and the risk tolerance of the owner and contractor.
